This webinar will explore the problems that prenups can pose to couples who want one, both in the process of  finalizing it and the effect that the terms of the prenup may have in the future to the health and success of the marriage. The presenter will discuss the typical toxic manner in which prenups are initiated, the problems of imbalance of power between the couple, and terms that are often embedded in prenups that have the potential for negative consequences to the marital relationship. The concepts of fiduciary duty in negotiating prenups (which is not a requirement in most states), and the high bar relating to contesting enforcement (“the unconscionability standard”) will also be discussed. Mediation as the preferred method to begin the process will be explained, as will the steps involved in the mediation process, and how to choose reviewing drafting attorneys who are meant to will keep an eye on the future health of the marriage rather than solely on asset protection for one or other of the future spouses.
